The Mental Capacity Act

The Mental Capacity Act 2005 affects anyone that is unable to make their own decisions due to a condition of their mind or brain (ie dementia, learning disability, brain injury, confusion due to alcohol, drugs or medication). The legislation is used on a daily basis by hospitals, care homes, local authorities and families.

This easy to use App enables the user to quickly read and refer to the main parts of the Mental Capacity Act such as the principles, the capacity assessment and best interests. For the practitioner, clicking on key words instantly provides additional screens with definitions, practical examples and Code of Practice guidance. A multiple choice quiz at the end of the app will consolidate the learning process.

The App will be easily at hand for assistance during mental capacity assessments or best interests meetings. It avoids the need to carry additional books or paperwork and is a tool to constantly refresh the practitioners memory. For students, it provides an excellent revision tool covering the most pertinent parts of the Act.

Family and carers will find it useful when talking to professionals in health and social care. They may wish to ask questions of staff such as social workers or doctors on their use and recording of the Act. Families will also be able to use this App to equip them to become more involved in the decision making processes within the Act.

Welsh users: please note this App has been created for England but the majority of the law within it is applicable in Wales too.

Please Note: The order of the mental capacity assessment in this App follows the order recommended by the Court of Appeal in the case of PC & Anor v City of York Council [2013] EWCA Civ 478. This is because the Court of Appeal has greater authority than the Mental Capacity Act Code of Practice.
